PRIVACY POLICY AND COOKIES

The privacy of visitors to our website https://zamgroup.it  is very important to us, and we are committed to protecting it. This privacy and cookie policy (hereinafter referred to as the "Policy") explains what we will do with your personal information.

This Policy applies only to information collected on our website https://zamgroup.it, therefore we are not responsible for the privacy policies or content of third-party websites.

1. Terms and Definitions

1.1. "Website" (hereinafter referred to as the "Site") – an information resource on the Internet, located at https://zamgroup.it, containing textual, graphical and other information that is perceived as a whole and is supported by a complex of system software.

1.2. "Site Owner" (hereinafter referred to as the "Owner") – Individual entrepreneur Holubenko Volodymyr, who is the owner and controller of the Site Users' personal data.

1.3. "User" – any natural person who has ever accessed the Site and has reached the age eligible for accepting the User Agreement posted on the Site and this Policy.

1.4. "Account" – a User's account created at the time of authorization on the Site, allowing the Owner to identify (authorize) the User through the use of the User's account on social networks Facebook, Twitter or Google.

1.5. "Personal Data" – information or set of information about a User who is identified or can be specifically identified.1.6. "Services" (Site services) – any services offered on the Owner's Site.

2. Collection and Use of Personal Data

2.1. Use of the Site does not require registration and/or authorization and direct provision of personal data that can identify you, except for the case provided for in clause 2.2. of the Policy.

2.2. At your discretion, for greater convenience of using the Site, you can authorize on the Site by using a personal account on social networks Instagram or Google.

2.3. When using the Site, we may automatically collect information related to your use of the Site.

2.4. We may collect, store and use the following types of your personal data:

2.4.1. information about your computer, including IP address, geographic location, browser type and version, and operating system;

2.4.2. information about your visits to and use of this Site, including referral source, length of visit, page views, and navigation paths on the Site;

2.4.3. information that you provide when registering an account on our Site in accordance with clause 2.2. of this Policy, such as your name, photos from the social network through which authorization was made, gender, date of birth, interests and hobbies, education and employment details, email address, contact information;

2.4.4. information such as name and email address that you enter to set up subscriptions to our emails and/or newsletters;

2.4.5. information that you enter while using services on our Site;

2.4.6. information that is generated while using our Site, including when, how often, and under what circumstances you use it;

2.4.7. information relating to services ordered on the Site, or transactions that you carry out through our Site, including name, address, phone number, email address, and your credit card details;

2.4.8. information that you post on our Site for publication on the Internet, including username, profile picture, and the content of your posts;

2.4.9. information contained in any messages that you send to us by email or through our Site, including their content and metadata;

2.4.10. any other personal information that you send to us.

2.5. Before providing us with personal information about another person, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this Policy.

2.6. When you visit the Site, a connection is established, access to data on the Site is made, and a log file is created. It may contain:

– date and time of access to the Site;

– IP address from which access to the Site was made;

– data or file name that you accessed on the Site;

– amount of time spent on the Site;

– name and version of your web browser, operating system;

– name of the website from which you came to the Site;

This information is used to improve the Site's performance, for security reasons, to ensure the Site's stability, and to protect the Site from possible external attacks. In addition, we may perform statistical analysis of this data. The data stored in the log file does not allow us to identify you personally. The data in the log file is used only for the purpose specified in this Policy and is not transferred to third parties, except for cases provided for in clause 7.2 of the Policy.

We collect only personal data that is consciously and voluntarily provided by you as the subject of personal data for the purpose of using the Site's services, which in accordance with the requirements of current Ukrainian legislation constitutes the consent of the personal data subject to the processing of their personal data in accordance with the purpose of processing stated in this Policy.

2.8. We guarantee that we will not sell or rent User's personal data to third parties, except in cases where disclosure of your personal data is necessary to comply with the requirements of current Ukrainian legislation.

2.9. We do not collect or process information about your personal data regarding racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties and trade unions, criminal convictions, as well as data concerning health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine "On Personal Data Protection").

3. Processing of Personal Data

3.1. Processing and storage of provided personal data is carried out in data centers where equipment that ensures the functioning of the Site's services is located. The provided personal data is processed and may be stored in the Personal Data Database or a separate table of the Site's Database. 4. Purpose of Personal Data Use

4.1. We may use your personal information for the purpose of:

4.1.1. administering our Site and business;

4.1.2. personalizing our Site for you;

4.1.3. enabling you to use the services available on our Site;

4.1.4. sending you statements, invoices and payment reminders and collecting payments from you;

4.1.5. sending you non-marketing commercial communications;

4.1.6. sending you email notifications when you are subscribed to email notifications;

4.1.7. sending you our email newsletter when you are subscribed to the newsletter. You can also notify us at any time if you no longer need the email newsletter;

4.1.8. sending you marketing communications relating to our business or the businesses of carefully selected third parties which we think may be of interest to you by email. You can also notify us at ohcodedesign@gmail.com if you no longer need marketing communications;

4.1.9. providing third parties with statistical information about our users (but those third parties will not be able to identify any individual user from that information);

4.1.10. dealing with inquiries and complaints made by or about you relating to our Site;

4.1.11. keeping our Site secure and preventing fraud;

4.1.12. verifying compliance with the terms and conditions governing the use of our Site (including monitoring private messages sent through our Site private messaging service);

4.1.13. and other uses

4.2. If you wish to provide personal information for publication on our Site, we will publish and otherwise use that information in accordance with the permission and/or license you grant to us.

4.3. Your privacy settings can be used to limit the publication of your information on our Site and can be adjusted using privacy controls on the Site.

4.4. We will not, without your express consent, provide your personal information to any third party for their direct marketing or any other purposes, except as required by current Ukrainian legislation.

5. PERSONAL DATA RETENTION PERIOD

5.1. Personal data is stored for no longer than necessary according to the purpose of its processing.

5.2. After you cease to be a Site User by deleting your Account on the Site, your personal data is also automatically deleted.

6. SITE INTERACTION WITH OTHER RESOURCES

6.1. When you use the services, codes from other internet resources and third parties may be present on the Site pages, resulting in such internet resources and third parties receiving your data. These internet resources may receive and process information about your visits to these pages, as well as other information transmitted by your browser. Such internet resources may include:

- banner display systems (for example, DoubleClick for Publishers, Admixer, AdRiver, etc.);

- social network plugins (for example, Discus, Facebook, Twitter, Google+).

6.2. The use of these services is necessary for operational analysis of Site visits, internal and external evaluation of Site traffic, depth of views, and User activity. We do not store or process data received from these services.

6.3. If for any reason you do not wish for the services specified in clause 6.1. of the Policy to have access to your personal data, you can voluntarily log out of your Account and clear cookie files (through your browser).

7. OWNER'S INTERACTION WITH THIRD PARTIES REGARDING PERSONAL DATA

7.1. We do not transfer personal data to third parties, except in cases where such transfer is required by current Ukrainian legislation, at the request of the personal data subject, or in other cases outlined in this Policy. We understand that personal information is valuable and an integral content, including personal non-property rights of any individual, therefore we take all possible measures to protect your personal information.

7.2. Access to your personal data may be granted to our authorized employees who have agreed to ensure the confidentiality of Users' personal data, as well as third parties who provide us with Site support and administration services, other services related to the Owner's business activities. Our authorized employees and/or third parties under contracts concluded with us undertake to comply with all requirements of current Ukrainian legislation regarding the protection of Users' personal data and their confidentiality.

7.3. The Site may contain links to other websites (for information purposes only). When following links to other websites, this Policy will not apply. Therefore, we recommend that you review the privacy and personal data policy of each website before transferring any personal data by which you can be identified.

7.4. Personal information that you publish on our Site may be accessible via the Internet worldwide. We cannot prevent the use and misuse of such information by third parties in other countries.

8. PROTECTION OF PERSONAL DATA

8.1. We use generally accepted standards of technological and operational protection of information and personal data from loss, misuse, alteration, or destruction, but we do not guarantee absolute protection from any threats arising outside our regulation.

8.2. We ensure the application of all relevant confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or unlawful disclosure or processing of such information and data, their accidental loss, destruction, or damage.

8.3. We have the right to distribute personal data without your consent in cases determined by current Ukrainian legislation, and only (if necessary) in the interests of national security, economic well-being, and human rights.

8.4. If you have provided / lost access to your Account, you bear full and independent responsibility for the actions of the new User when using the Site and/or Site Services from your Account.

9. CONDITIONS OF ACCESS TO PERSONAL DATA

9.1. The procedure for third-party access to personal data is determined by the terms of the User's consent given to the Owner for the processing of this data, or in accordance with legal requirements.

9.2. You have the right to receive any information about yourself from any subject of relations related to personal data, provided that you specify your surname, first name and patronymic, place of residence (place of stay) and details of the document identifying the individual making the request, except in cases established by current Ukrainian legislation.

9.3. Access to data about oneself is free of charge. Delay in access to one's personal data is not allowed. Delay in access to personal data by third parties is allowed if the required data cannot be provided within thirty calendar days from the date of receipt of the request. The total period for resolving issues raised in the request cannot exceed forty-five calendar days.

9.4. Notification of delay is brought to the attention of the third party who submitted the request, in written form with an explanation of the procedure for appealing such a decision.

9.5. Denial of access to personal data is allowed in accordance with current Ukrainian legislation if access to them is prohibited under the Law of Ukraine "On Personal Data Protection".

9.6. The decision to delay or deny access to personal data may be appealed to the Ukrainian Parliament Commissioner for Human Rights or to court.

10. YOUR RIGHTS AS A USER (PERSONAL DATA SUBJECT)

10.1. You, as a User (personal data subject) have the right to:

1) know about the sources of collection, location of your personal data, purpose of their processing, location of the Owner or give appropriate instructions to receive this information to authorized persons, except in cases established by the Law of Ukraine "On Personal Data Protection";

2) receive information about conditions of access to personal data, particularly information about third parties to whom their personal data is transferred;

3) access your personal data;

4) receive, no later than thirty calendar days from the date of request, except in cases provided by the Law of Ukraine "On Personal Data Protection", an answer about whether their personal data is being processed, and also receive the content of such personal data;

5) present a motivated demand to the Owner with objection against the processing of your personal data;

6) present a motivated demand regarding the change or destruction of your personal data by the Owner if this data is processed illegally or is inaccurate;

7) protect your personal data from illegal processing and accidental loss, destruction, damage due to intentional concealment, non-provision or untimely provision, as well as protection from the provision of information that is inaccurate or damages your honor, dignity and business reputation;

8) file complaints about the processing of your personal data to the Ukrainian Parliament Commissioner for Human Rights or to court;

9) apply legal protection measures in case of violation of current Ukrainian legislation on personal data protection;

10) make reservations regarding the restriction of the right to process your personal data when giving consent;

11) withdraw consent to personal data processing;

12) know the mechanism of automatic personal data processing;

13) protection from automated decision-making that has legal consequences for them.

11. COOKIES

11.1. Our Site uses cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies can be either "persistent" cookies or "session" cookies: a persistent cookie will be stored by a web browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed. 11.2. The names of the cookies that we use on our Site, and the purposes for which they are used, are set out below:

and in Chrome you can block all cookies by accessing the "Customize and Control" menu, and clicking "Settings," "Show advanced settings," and "Content settings," and then selecting "Block sites from setting any data" under the "Cookies" heading.

11.3. Blocking all cookies will have a negative impact on the usability of many websites. If you block cookies, you will not be able to use all the features on our Site.

11.4. You can delete cookies that are already stored on your computer. Deleting cookies will have a negative impact on the usability of many websites.

In Internet Explorer (version 10), you must manually delete cookie files (instructions for doing this can be found at http://support.microsoft.com/kb/ 278835);

In Firefox (version 24), you can delete cookies by clicking "Tools," "Options," and "Privacy", then selecting "Use custom settings for history", clicking "Show Cookies," and then clicking "Remove All Cookies";

And in Chrome (version 29), you can delete all cookies by accessing the "Customize and Control" menu, and clicking "Settings," "Show advanced settings," and "Clear browsing data," and then selecting "Delete cookies and other site and plug-in data" before clicking "Clear browsing data."

12. POLICY CHANGES

12.1. We reserve the right to publish separate privacy notices, as well as to change and/or supplement the content of the Policy at any time at our own discretion.

12.2. In case of significant changes to the Policy, we will post a notice on the Site and specify the effective date of these changes. If during the specified period you do not refuse to accept these changes in writing, this will mean that you have agreed to the corresponding changes in the Policy.
